Appellate Court Upholds Ruling for SmartDisk Corporation

Fort Myers, FL, 5/26/2005– SmartDisk Corporation announced today that the U.S. Court of Appeals for the Federal Circuit has favorably affirmed the final judgment of non-infringement rendered by the U.S. District Court for the Middle District of Florida in a lawsuit against SmartDisk. The lawsuit, filed in June 2000, alleged that SmartDisk's Smarty and FlashPath products infringed a U.S. patent asserted by PC Connector Solutions, LLC.

The Court of Appeals decision, upholding the District Court's Summary Judgment ruling of December 2003, finally resolves the legal issue between the parties," commented Michael S.
